3 persons arrested in Kennedale Car Wash Murder; 2 others previously accused now cleared

According to Kennedale Police, who also claim to have three other individuals in jail who are responsible for the incident, two men suspected of capital murder in a double shooting that also injured a child in October 2022 have been absolved of all charges.

On November 18, 2022, Kennedale Police reported the arrests of Xavier Aguilar, 21, and Sonny Ayala, 20, who were both in relation to the killing of 18-year-old Hayden Scarlato. Both individuals were charged with several offenses, including capital murder.

On October 26, 2022, Scarlato was shot and killed while parked at a car wash in the 6300 block of Treepoint Drive with an unidentified young person. The kid, whose name has not been made public, survived the gunshot, although it is unknown how they are doing.

Aguilar and Ayala have been exonerated of all allegations, according to Kennedale Police, who did not provide any more information regarding the circumstances behind the men’s initial accusation of murder, aggravated assault, and involvement in organized crime or their subsequent exoneration.

Additionally, no reason for the double shooting has been disclosed by investigators looking into the death of Scarlato.

In a statement issued on Tuesday, Kennedale Chief of Police Mike Holguin named three additional suspects he said were now being held in connection with the killing of Scarlato.

Holguin claims that Kristopher Luebano was detained on November 15, 2022, while Nicolas Luebano was detained on November 9, 2022. According to authorities, both individuals were detained in Ellis County and charged in the Scarlato case with capital murder and aggravated assault with a dangerous weapon.

These arrests, which reportedly occurred days before the ones of Ayala and Aguilar on November 17, were not made public until recently.

In his announcement on Tuesday, Holguin said that the arrest of the Luebanos coincided with the discovery by his agency on December 31, 2022, of an outstanding warrant for Emmanuel Bear, 19, in connection with the slaying of Scarlato. Bear had been captured by the Marshals Service in Allen.

In a statement released on Tuesday, the Kennedale Police Department stated that it “does not have any other specifics surrounding the arrest of Bear, which is now under investigation by agencies engaged in his apprehension.”

NBC 5 has contacted Kennedale Police to learn more about why the arrests of Nicolas and Kristopher Luebano were not made public in November 2022, along with the announcement of the arrests of Ayala and Aguilar on November 18, 2022, and why there was no reference at the time to an unsolved capital murder suspect.

The Drug Enforcement Agency (DEA), the Bureau of Alcohol, Tobacco, and Firearms (BATF), the United States, Grand Prairie Police Department, Mansfield Police Department, Arlington Police Department, and Kennedale Police, according to a statement released by the latter on Tuesday. The Ellis County Sheriff’s Office and the U.S. Marshals Service (USMS).

Other Crimes

Police in Fort Worth are looking into a triple shooting that occurred Wednesday night.

Just before 8 o’clock in the evening, West Division police were sent to the 700 block of Panay Way to reports of several victims on the spot. Personnel from MedStar and the Fort Worth Fire Department also responded.

The three victims are being treated by officers and emergency personnel, and investigators are already on the site. This was a developing story.
