A 33-year-old man named Joseph Halm Arcidiacono was no-billed by a grand jury after being originally charged with aggravated assault with a deadly weapon when he hurled two unopened cans toward Senator Ted Cruz while waving to the crowds in lining Smith street.
The senator was struck in the chest and neck area and luckily do not need to seek medical attention. Arcidiacono posted a bond set at $40,000 after being arrested. During his detention, he allegedly told officers, “I know, I’m an idiot. I’m sorry.”
According to Arcidiacono’s lawyers, his “dream” was to make an Astros player get one of the beers from his cooler and drink it, as many athletes are known to do. They said that fans really throw cans at people during championship parades to get players to chug. Arcidiacono claimed that he was attempting to throw a can at Cruz hoping that he would crack it open and drink it too.
Arcidiacono’s lawyers released a statement apologizing to Cruz and asking for grace to drop the charges.
Cruz joked about Arcidiacono’s weak throw and brushed off the incident. He said in a statement that he was thankful to the Houston Police and Capitol Police for their quick action.
